Luis Merino

In this case, Knox’s comments are pcretoted under the first amendment. She has every right as citizen to display her opinions publicly, no matter who is against it. However, this does not mean she will not be penalized as a professional teacher for her public comments. In Tinker vs. Des Moines, the court ruled that teachers and students are still granted their first amendment rights on school grounds, but they must not be disruptive of the school’s environment. Knox’s comments were affiliated with the school. On her Facebook page, she expressed her hateful feelings about a Lesbian Gay Bisexual Transgender History Month poster in the school. These comments might causes disruption and may interfere with student’s learning because they might feel uncomfortable. To the public’s eye, Know is recognized as a teacher, which made her a role model amongst students. Since her Facebook was not set on private and she identified herself as teacher, the public was able to judge her actions based on her profession and the impact it has on her professional work and environment. Since it was a public comment and it had to do with the school, Knox should be penalized as a teacher for her Facebook comments.
